Warranty Terms & Conditions and General Terms & Conditions
12 Month warranty applies to all JnA Products Ltd goods, unless otherwise stated. Conditions of warranty are set out in clauses 1, 2, 3, 4 & 5 below.
1. JnA Products warrants that if any defect in any workmanship of supplied goods from JnA Products Ltd becomes apparent and is reported to JnA Products Ltd within twelve (12) months of the date of delivery (time being of the essence) then JnA Products Ltd will either repair the defect, replace the good/s or refund the purchase price.
2. The conditions applicable to the warranty given by clause 1 are:
(a) 12 Month warranty is ‘Return to base’ (hereafter referred RTB). Goods are to be returned to JnA Products current warehouse location.
(i) At JnA Products sole discretion they may repair the goods off site of JnA Products location.
(b) A documented service history must be provided to JnA Products on request.
(c) The decision to Repair/Replace/Refund of the goods is at JnA Products sole discretion.
(i) If the decision made by JnA Products is to refund the purchase price, the amount refunded will be the purchase price not including freight costs.
(d) the warranty applies on the basis of the Goods being used on the equivalent of a single daily eight (8) hour shift per 24 hour period.
(e) the warranty shall not cover any defect or damage which may be caused or partly caused by or arise through:
(i) failure on the part of the Buyer to properly maintain any Goods .
(1) maintenance schedules are provided at the time of purchase.
(2) Including maintaining the good to current NZ legislation. i.e. pressure vessels.
or
(ii) failure on the part of the Buyer to follow any instructions or guidelines provided by JnA Products Ltd.
or
(iii) any use of any Goods otherwise than for any application intended as indicated by the product name and description.
or
(iv) the continued use of any Goods after any defect becomes apparent or would have become apparent to a reasonably prudent operator or user
or
(v) fair wear and tear of the Goods or any part thereof including but not limited to threads, fuses, filters, pressure seals, pressure vessels, corrosion
or
(vi) misuse, neglect, accident, vandalism, damage in transit or any act of God.
(f) the warranty shall cease and JnA Products Ltd shall thereafter in no circumstances be liable under the terms of the warranty if the workmanship is repaired, altered or overhauled without JnA Product’s consent.
(g) in respect of all claims JnA Products shall not be liable to compensate the Buyer for any delay in either replacing or remedying the workmanship or in properly assessing the Buyer’s claim.
3. in the respect of damage or loss JnA Products shall not be responsible for any loss or damage to the Goods, or caused by the Goods, or any part thereof however arising.
4. In the case of second hand Goods, the Buyer acknowledges that he/she has had full opportunity to inspect the same and that he/she accepts the same with all faults and that no warranty is given by JnA Products as to the quality or suitability for any purpose and any implied warranty, statutory or otherwise, is expressly excluded. JnA Products shall not be responsible for any loss or damage to the Goods, or caused by the Goods, or any part thereof however arising.
5. In addition to the above conditions, Goods specifically stated as 3 year / 6600 hour warranty. For this warranty period to apply the following conditions must be meet:
(a) The servicing schedule must be maintained as stipulated with the Goods.
(b) Proof of servicing must be supplied when requesting warranty.
(c) All servicing parts must be purchased through JnA Products.
(d) Any outstanding accounts must be up to date and paid in full, prior to any warranty claim being assessed.
(e) If using a 3rd party to complete the servicing, written permission must be obtained from JnA Products for the stated warranty period to be effective.
(f) This warranty is not transferable between parties.
(g) This stated warranty covers replacement parts only. Labour, travel, accomodation and any other expenses are chargeable to the customer.
(h) 3 years is 1095days from the invoice date.
(i) 6600 hours is the total running hours as displayed on the controller of the Goods.
(j) 3 years or 6600 hours whichever occurs first, after which ever period is meet first warranty does not apply.
